Dave Burton (Dennis O’Keefe), a successful music publisher, is being sued for plagiarism by lawyer Elizabeth Smith (Louise Allbritton), who represents songwriters Ben Pollard (‘Frank Faylen’ (q))and Harry Pollard (Ralph Peters). Their claim is that a current hit song published by Burton and sung in a Broadway show by his somewhat ill-tempered girl friend, Mira Byron (Mary Beth Hughes), was not written by Charlie Martin (Murray Alper) as claimed on the sheet music. And they have a good claim, as the Pollards had played their tune, under another title, for Burton, who turned it down, but went around his office unconsciously whistling it. Martin heard it and wrote it down as his own composition. |
